Scandjets travel conditions
1. Contract
1.1 Scandjet (travel agent) is to be held responsible towards the traveler for what he has right to demand arising from the agreement. The responsibility also applies to services, executed by subcontractors to the travel agent if a retailer is a party in the agreement, he is responsible towards the passenger in the same way as the travel agent.
1.1.1 The orderer is the person booking the trip and thus enters into a contract with the travel agent. All changes and cancellations must be made by the orderer or traveler.
1.2 Information on the travel agent's website legaly binds the travel agent. The travel agent may change the information on the website. However, this should only happen if the traveler is clearly informed of the changes.
1.3 The travel agent shall keep the traveler informed on issues of importance to the traveler associated with the contract.
1.4 The traveler is responsible fully for any connection trips and special arrangements that are not sold or marketed by the travel agent.
1.5 The contract is legaly binding for both parties when the travel agent has confirmed the travelers reservation in writing and the traveler within the agreed timeperiod pays the agreed deposit in accordance with the travel agents's instructions. The travel agent shall confirm the traveler's request without delay.
1.6 If the Agreement is changed by the traveler, for example: change of departure airport, change of departure date or extent in time, the trip will be regarded as a cancellation and a re-booking that will be charged according to, at the time of the re-booking, current price list. A re-booking fee will be charged in accordance with the cancellation conditions. Changes are subject to availability and can only be made no later than 7 days prior to departure. There present re-booking fee is SEK 250 (or local currency equivalent). Re-booking fee and the difference between the original fare and the lowest available price for the new booking, at the time of the re-booking rebooking, will be charged per flightsector and person, for each re-booking. If the available price is lower than the original, at the time of rebooking, no refund will be made by the travel agent.
2. Payment for the trip
2.1 Traveler must pay in full on reservation. The reservation is confirmed only when payment in full has been made. Payment can only be made by creditcard. Accepted creditcards are MasterCard and VISA.
2.2 The contract is binding only when payment has been made in full, as stipulated in 2.1.
3. Traveler's right to cancel the trip
3.1 The passenger has the right to cancel the trip as follows:
3.1.1 For cancellations more than 45 days prior to departure departure, the traveler must pay a cancelation fee of EUR 85.
3.1.2 For cancellations less than 45 days, no refund will be made to the traveler.
3.1.3 Should the traveler cancel a trip according to 3.1.2, money will be refunded to the traveler no later than 14 days after cancellation.
3.1.4 Should the traveler make a wrongful payment, the travel agent has the right to claim an administrative fee (10 EUR) for the extra work and banking transaction that will be needed to reimburse the payment.
4. Travel agents right to changes prior to departure, cancelation of the trip, the right to refuse transport and right to cancel contract
4.1 The travel agents right to change the contractual conditions
When too few reservations have been made for a particular trip, the travel agent may cancel the trip. Notification about cancellation or any other change to the tripp must be made at least 14 days prior to departure
4.2 The travel agents right to refuse transport
The travel agent has the right to refuse transport of travelers and their luggage. The reason for such a decision may be:
- If the travelers conduct and/or physical and/or mental condition and/or the contents of the travelers luggage could cause distress to himself, or create concern for other passengers on board and/or members of the crew.
- If full payment for ticket/reservation plus any applicable fees have not been paid or that the credit arrangement between travel agent and traveler (or the person or company who paid for your ticket) are not followed
- If the travelers travel documents or other documents such as passports or other identification card is missing, is reported missing, shows signs of forgery or otherwise invalid or exhibit signs of being invalid
- If a traveler intending to check in or board the airplane can not prove that his or her name is the same as that printed on the ticket. In this case, we reserve the right to retain the ticket
- If the total weight of the travelers baggage exceeds the permitted rules
4.3 The travelers to withdraw from the contract
The traveler may withdraw from the contract, the travel agent declares that he will not be able to fulfill what he has committed in the contract, and the breach of the contract is essential to the traveler. The traveler may withdraw from the contract if the change poses a significant disadvantage for the traveler.
For schedule changes the traveler is entitled to receive full refund if the trip is cancelled within 20 days of receipt of the information about the schedule changes.
4.4 Amendments to the price
Applicable taxes, fees and charges imposed by any government or any other authority or by the operator of an airport in relation to your Ticket, shall paid by the traveler. At the time of the purchase of a ticket, the traveler will be advised of taxes, fees and charges not included in the fare and they will normally be shown separately on the ticket. The taxes, fees and charges imposed on air travel are constantly changing and can be imposed after the date of ticket issuance. If there is an increase in a tax, fee or charge shown on the ticket, the traveler will be obliged to pay it. Likewise, if a new tax, fee or charge is imposed even after ticket issuance, the traveler will be obliged to pay it. Similarly, in the event any taxes, fees or charges which the traveler have paid to the travel agent at the time of the ticket issuance are abolished or reduced, you will upon contacting us be
entitled to a refund.
4.5 The travel agents and travelers right to cancel contract
The parties have the right to cancel the contract if there occurs a catastrophe, act of war, general strike or other serious event at the travel destination or the planed travel route that significantly affects the possibility to go through with the trip. To define if the incident is of such grave nature as mentioned above, a special adviser or international authority has to be consulted.
4.6 The travel agent also has the right to cancel contract if incidents occur that are beyond the travel agents powers, such as Force Major, strikes, acts of war etc.
5. The travelers’ responsibility during trip
5.1 Check-in
As a rule the check-in disk opens 2 hours before scheduled departure and closes 60 minutes before scheduled departure. The travel agent has the right to deny the traveler to board the flight if the traveler does not get to the check- in disk in time. The traveler has in this case no right to a refund.
5.2 Schedules
Before we accept your booking, we or our Authorised Agents will notify you of the scheduled flight time in effect as of that time and such flight time will be shown on your Ticket. It is possible that we may need to change the scheduled flight time subsequent to the issuance of your Ticket. If traveler provides travel agent with contact information, we will try to notify you of any such changes.
The travel agent is not responsible for missing connecting flights or other transport due to changes in schedule, canceled or delayed flight.
5.3 Baggage
The allowed weight for checked-in baggage is 15 kg/ passenger. A smaller cabin baggage is allowed. This should have the maximum weight of 5 kg and be smaller than 50 cm x 35 cm x 23 cm.
5.4 Items unacceptable as Baggage
5.4.1 You must not include in your Baggage:
(a) items which are likely to endanger the aircraft or persons or property on board the aircraft, such as those specified in the International Civil Aviation Organisation (ICAO) Technical Instructions for the Safe Transport of Dangerous Goods by Air, in the International Air Transport Association (IATA) Dangerous Goods Regulations, in the Commission Regulation (EC) No 68/2004 of 15 January 2004 amending Commission Regulation (EC) No 622/2003 laying down measures for the implementation of the common basic standards on aviation security,]and in Our Regulations (further information is available from us on request);
(b) items of which the Carriage is prohibited by any Laws of any state to
be flown from, over or to;
(c) animals,
(d) items which are reasonably considered by us to be unsuitable for Carriage because they are dangerous or unsafe, or by reason of their weight, size, shape, content or character, or which are fragile or perishable having regard to, among other things, the type of aircraft being used. Information about unacceptable items is available on request.
5.4.2 Firearms and ammunition other than for hunting and sporting purposes are prohibited from Carriage as Baggage. Firearms and ammunition for hunting and sporting purposes may be accepted as Checked Baggage. Firearms must be unloaded with the safety catch on and suitably packed. Carriage of ammunition is subject to ICAO, IATA and EC regulations as specified in Article 9.3.1 (a).
5.4.3 Weapons such as antique firearms, swords, knives and similar items may be accepted as Checked Baggage, at our own discretion, but will not be permitted in the cabin of the aircraft.
5.4.4 You must not include in Checked Baggage money, keys, prescribed medicines, jewellery, passports and other identification documents or samples, precious metals, fragile or perishable items, computers, cellular telephones, personal electronic devices, negotiable papers, securities, business documents, or other important or valuable items.
5.4.5 If, despite being prohibited, any items referred above are included in your Baggage, we shall not be responsible for any loss, delay or damage to such items.
5.5 Right of search
For reasons of safety and security we may request that you permit a search and scan of you and a search, scan or x-ray of your Baggage. We will normally search, scan or x-ray your Baggage in your presence. However, if you are not available, your Baggage may be searched in your absence. If you are unwilling to comply with any requests on search, scan or x-ray, we may refuse to carry you and your Baggage. In the event a search or scan causes Damage to you, or a search, x-ray or scan causes Damage to your Baggage, we shall not be liable for such Damage unless due to our fault or negligence.
5.6 Checked Baggage
Upon delivery to us of your Baggage for check-in, we will take custody of andissue a Baggage Identification Tag for each piece of your Checked Baggage. Checked Baggage must have your name and address, or other personal identification, affixed to it. Checked Baggage, not exceeding the free Baggage allowance, will whenever possible be carried on the same aircraft as you, unless we decide for safety, security or operational reasons to carry it on an alternative flight. If your Checked Baggage is carried on a subsequent flight we will deliver it to you as agreed, unless any Laws require you to be present for customs clearance or for any other reason
5.7 Unchecked Baggage
We have specified maximum dimensions and weight for Unchecked Baggage. Further, Unchecked Baggage must fit under the seat in front of you or in anenclosed storage compartment in the cabin of the aircraft. If your Unchecked Baggage cannot be stored in this manner, or is of excessive weight, or is considered unsafe for any reason, it must be carried as Checked Baggage. Upon request Our Regulations on Unchecked Baggage are available from us or our Authorised Agents. Please note that the conditions regarding Unchecked Baggage may vary between different air carriers. Objects not suitable for Carriage in the cargo compartment (such as delicate musical instruments), will only be accepted for Carriage in the cabin compartment if you have given us notice in advance and permission has been granted by us. You may have to pay a separate charge for this service.
5.8 Collection and delivery of Checked Baggage
You are required to collect your Checked Baggage as soon as it is made available at your destination or Stopover. Should you not collect it within a reasonable time, we may charge you a storage fee. Should your Checked Baggage not be claimed within three (3) months from the time it made available, we may dispose of it without any liability to you. Only the bearer of the Baggage Check and the Baggage Identification tag, is entitled to delivery of the Checked Baggage. If a person claiming Checked Baggage is unable to produce the Baggage Check and identify the Baggage by means of a Baggage Identification Tag, we will deliver the Baggage to such person only on condition that he or she establishes to our satisfaction his or her right to the Baggage.
5.9 Necessary documentation
The traveler is in charge of bringing all the necessary documentation for the trip as; valid passport, visa, vaccination, insurance etc. The traveler has to pay all costs that can arise if necessary formalities are not in order, as home transport because not having valid passport, visa etc.
6. Children and pregnancy
6.1 Children below 2 years will pay 40 EUR for a round trip- The child will be placed in parents knee. The travel agent has the right to refuse boarding if false age has been specified at time of booking. If there are free seats available there will be a possibility to by a new ticket to full price.
6.2 If you are pregnant carrying one child you are welcome to travel with us until four weeks befor expected delivery without any medical certificates or restrictions on flying time. From four to two weeks before expected delivery, a special medical information form (MEDIF), is required. The travel must also be authorized by the travel agent. The flying time between any take off and landing may not exceed four hours. We cannot accept you on board two weeks or less before expected delivery. Please make sure to check with your insurance company at which stage of the pregnancy your insurance is valid
6.3 Special assistance
Acceptance for Carriage of unaccompanied children, incapacitated persons, pregnant women, persons with illness, or other people requiring special assistance is subject to prior arrangement with us. Passengers with disabilities who have informed us of any special requirements they may have at the time of reservation and whose requirements have been accepted by us, shall not be refused Carriage on any flight comprised of the reservation on basis of such disability or special requirements.
7. Other
7.1 Food and beverage
A lighter meal will be served during the flight.
7.2 Ticket and booking number
The booking number that will be received when booking is confirmed by travel agent will, after full payment be the travelers’ e-ticket to use at check-in. A ticket is personal and may not be passed on to third party.
7.3 Typo
The travel agent is not liable for eventual typos on webpage, travel document and catalogues.
7.4 Animals
Animals are not permitted on plane.
8. Dispute
The parties should try to solve any dispute concerning the interpretation or adaption of contract. If parties cannot come to an agreement, the dispute can be presented at court.
